LeadMarket 360 Privacy Policy

1. Who we are and what this policy covers

LeadMarket 360 LLC ("LM360," "we," "us") is a lead generation and data company. We connect consumers who ask for information about products and services with businesses that offer them, and we sell consumer leads and related data to those businesses.

This Privacy Policy explains what personal information we collect, how we use it, who we share or sell it to, and the choices and rights you have. It applies to leadmarket360.com, its subdomains, the web forms and landing pages we operate, and our calls, texts and emails (together, the "Services").

It does not apply to websites, apps or businesses we do not operate, including the partners who receive your information from us. Each of them handles your information under its own privacy policy.

By using the Services, you acknowledge the practices described here. If you do not agree with them, please do not submit your information to us.

2. Information we collect

We collect information you give us, information collected automatically when you use the Services, and information we receive from other sources.

Information you provide. When you fill out a form, request a quote, call us, or open an account, we may collect:

Information collected automatically. When you visit our sites, we and our service providers collect your IP address, device and browser type, pages viewed, referring site, time and date of visit, approximate location derived from your IP address, and similar usage information. We collect this through cookies, pixels and similar technologies (see Section 6).

Information from other sources. We may receive information about you from partner websites where you asked to be contacted, from data verification and fraud-prevention providers, and from publicly available sources. We may combine it with information we already hold.

Sensitive information. We do not ask for Social Security numbers, full bank or card numbers, or medical records through our consumer forms. Please do not send them to us. Business customers' payment card details are processed by our payment processor.

3. How we use your information

We use personal information to:

4. How we share and sell your information

We sell and share personal information. Lead generation is our business. When you submit a request through the Services, we sell or otherwise provide your information to businesses that may contact you about their products and services. You can opt out at any time (see Section 7).

We disclose personal information to:

We do not sell or share a business customer's payment details with marketing partners.

5. Calls, texts and emails

Your consent. We, and the partners named on a form, contact you by phone or text only when you have given consent on that form, or when the law otherwise allows it. That includes calls and texts made with automated technology or prerecorded or artificial voice. The form tells you who may contact you and how. Consent is never a condition of buying any product or service. Message and data rates may apply, and message frequency varies.

Our text messages. If you opt in to receive text messages from LM360, we use your mobile number and consent only to send the messages described in our SMS Terms. We do not share the opt-in or consent you give for LM360's own text program with third parties or affiliates for their marketing. A partner may text you only under consent you gave to that partner by name.

How to stop. Reply STOP to any text to stop texts from that sender. Reply HELP for help. You can ask any caller to place you on their do-not-call list. To stop all contact from LM360, email us at the address in Section 9. Partners who already received your information must be contacted separately to stop their messages.

Email. We send marketing emails only to people who agreed to receive them. Every marketing email includes an unsubscribe link. We will honor your request within 10 business days.

Call recording. Calls with LM360 may be monitored or recorded for quality, training and compliance. We will tell you at the start of the call where the law requires it.

6. Cookies, analytics and interest-based ads

Cookies, pixels and similar tools are small pieces of code or data that let a site recognize your browser. We and our partners use them to:

Some of these tools are placed by third parties, such as analytics and advertising providers. Their use of the data is governed by their own privacy policies. When partners use this data to show you ads based on your activity across sites, that can count as "selling" or "sharing" under some state laws. You can opt out as described in Section 7.

Your choices. You can block or delete cookies in your browser settings, though some features may stop working. You can opt out of interest-based ads from participating companies through the Network Advertising Initiative at optout.networkadvertising.org and the Digital Advertising Alliance at optout.aboutads.info.

Global Privacy Control. We treat a Global Privacy Control signal from your browser as a request to opt out of the sale and sharing of personal information tied to that browser.

7. Your privacy rights

Do Not Sell or Share My Personal Information. You can tell us to stop selling or sharing your personal information at any time, without giving a reason. Use any method below or turn on Global Privacy Control in your browser. Opting out stops future sales by LM360. It does not recall information already delivered to partners, so contact them directly to stop their use.

Other rights. Depending on where you live, you may have the right to:

We will not discriminate against you for using any of these rights.

How to make a request.

We confirm receipt within 10 business days and respond within 45 days. If we need more time, we will tell you why and take no more than 45 more days. We may need to verify your identity, and we will ask only for what that requires. An opt-out request does not need verification. You may use an authorized agent; we will ask for the agent's written permission and may confirm your identity with you directly.

Appeals. If we deny your request, we will explain why. You can appeal by replying to our decision, and we will answer within 60 days. If you are not satisfied, you may contact your state attorney general.

We do not knowingly sell or share the personal information of anyone under 16. Under California's "Shine the Light" law, California residents may also ask which third parties received their information for direct marketing in the prior calendar year by contacting us as described above.

8. Retention, security and other terms

Retention. We keep lead and consent records for up to five years so we can prove consent and respond to legal claims. We keep business customer records for as long as the account is open, plus the period tax and accounting law requires. We keep analytics data for the period set by the analytics provider. We then delete or de-identify the information, unless the law requires us to keep it longer.

Security. We use reasonable administrative, technical and physical safeguards to protect personal information. No website, transmission or storage system is completely secure, so we cannot guarantee absolute security. If your business account login is lost or misused, contact us right away.

Children. The Services are meant for adults 18 and older. We do not knowingly collect information from children under 13. If we learn that we have, we will delete it. Parents or guardians who believe their child gave us information should contact us.

Links and public areas. Our sites may link to websites we do not operate, and we are not responsible for their practices. Anything you post in a public area, such as a forum or review section, can be seen by others.

Changes to this policy. We may update this Privacy Policy. We will post the new version here and change the "Last updated" date. If we make a material change to how we use or share personal information, we will give notice on the site before it takes effect.
